Terms of Service for SwipePics

These Terms of Service (“Terms”) govern your access to and use of the SwipePics mobile application (SwipePics or the “App”), operated by APPMINDS LIMITED (“we,” “our,” or “us”). By downloading, accessing, or using SwipePics, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • Application refers to any application or software program provided by the Company.
  • Company refers to AppMinds Limited, Limassol, Cyprus.
  • Country refers to Cyprus.
  • Device means any device that can access the Service such as a computer, cellphone, or digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • You means the individual accessing or using the Service, or the entity on behalf of which such individual is accessing the Service.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use SwipePics. By using SwipePics, you represent that you meet these requirements.

3. License to Use SwipePics

We grant you a limited, non-exclusive, non-transferable, revocable license to use SwipePics for personal, non-commercial purposes in accordance with these Terms. You may not:

  • Modify, copy, distribute, or create derivative works of the App.
  • Use the App for commercial or public purposes without our prior written consent.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Remove or edit any copyright, trademark, or proprietary notices.

4. Access to Your Photo Library

SwipePics requires permission to access your device’s photo library solely to allow you to:

  • Review photos and videos stored on your device.
  • Choose whether to keep or delete assets.
  • Organize or manage your media.

Important Privacy Disclosure:

  • All photo scanning and analysis occurs entirely on your device.
  • Your photos and videos are never uploaded, transmitted, or stored on our servers.
  • We do not access, view, copy, or retain your personal media.
  • We do not use your photos for AI training or any external processing.

You may revoke photo access at any time through your iOS Settings.

5. Deletion Responsibility Disclaimer

SwipePics allows you to delete photos and videos from your device.

You acknowledge and agree:

  • All deletion decisions are initiated and confirmed by you.
  • Deleted items may be moved to the iOS “Recently Deleted” folder, subject to Apple’s system behavior.
  • Permanent deletion is governed by Apple’s iOS system policies, not by the Company.
  • We are not responsible for accidental deletion of media.
  • We strongly recommend backing up your device before deleting content.

To the fullest extent permitted by law, we are not liable for loss of photos, videos, or other digital content.

6. Subscriptions and Payments

SwipePics offers premium features through auto-renewable subscriptions (“SwipePics Pro”).

  • Billing: Payment will be charged to your Apple ID account upon purchase confirmation.
  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Management: You can manage or cancel your subscription in your App Store account settings.
  • Refunds: All billing, renewals, and refunds are handled by Apple via the App Store. We do not issue refunds directly.

7. Acceptable Use

You agree not to use SwipePics to:

  • Use the App in violation of any applicable laws
  • Attempt to bypass device-level permissions or security
  • Interfere with the proper functioning of the App
  • Use automation, bots, or scripts to manipulate App functionality

8. Data Usage and Security

SwipePics is designed with privacy in mind.

  • Your photos and videos remain on your device.
  • We do not upload, access, or store your personal media.
  • We do not sell your data.

9. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. We may suspend, modify, or discontinue features or services at any time without liability.

10. Intellectual Property

All rights, title, and interest in SwipePics (including software, trademarks, designs, and content not uploaded by users) remain the exclusive property of APPMINDS LIMITED and its licensors. Unauthorized use is strictly prohibited.

11. Disclaimer of Warranties

SwipePics is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that deletion actions cannot be reversed by your device’s operating system or third-party backup services.

12. Limitation of Liability

To the maximum extent permitted by law, APPMINDS LIMITED shall not be liable for:

  • Accidental deletion of photos or videos
  • Loss of data
  • Indirect, incidental, or consequential damages
  • Loss of profits, revenues, goodwill, or digital content

You acknowledge that deletion decisions are initiated and confirmed by you.

13. Termination

We may suspend or terminate your access to SwipePics at any time, without prior notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use SwipePics will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by other reasonable means. Continued use of SwipePics after changes are effective constitutes acceptance of the updated Terms.
